Can You Cancel a Mortgage Rescue Contract?

It is no secret by now that there are many ways to try to stop your foreclosure from happening, but there are almost equally as many ways that you can be scammed. These scams could be to simply take money from you that are masked as fees for a service or to try to take your home altogether, either way, they are harmful. This is why it is important to read everything you sign at the closing of your foreclosure rescue, and even more important, make sure that you have the option to cancel this rescue.

You can do this by reading through the contract you sign and questioning the person that is orchestrating the closing of your contract. If they tell you that there is the option to cancel but can not point it out in the contract, advise them that you are no longer considering and stop immediately. If they can make sure that you get a copy of the signed contract before you leave to have proof that you can cancel at any time.

Florida has made this very question part of a new law: “…The homeowner may cancel the foreclosure-rescue transaction agreement without penalty if the homeowner notifies the equity purchaser of such cancellation no later than 5 p.m. on the 3rd business day after signing the written agreement. Any moneys paid by the equity purchaser to the homeowner or by the homeowner to the equity purchaser must be returned at cancellation…”
